Update December 2019

A Consultation Report providing a summary of the feedback received is now available from the Summary of Results section below.

The revised policy, EqIA and consultation feedback was presented for consideration to the Environment and Transportation Cabinet Committee on 29 November. The Policy Statement will be adopted by the Cabinet Member for Planning, Highways, Transport and Waste in the coming weeks and will be available shortly.

As a Lead Local Flood Authority (LLFA), KCC has powers as a land drainage authority under the Land Drainage Act 1991 to regulate ordinary watercourses. This statement sets out how we will exercise these powers.

Prior to this policy statement, KCC exercised these powers according to the requirements of the Act and best practice. This statement formally sets out KCC’s policy, clarifying where we might act and provides details on how to apply for land drainage consent.

In particular, the policy statement sets out our policy towards culverting of watercourses, to which we are generally opposed, except in circumstances where it is necessary.

The consultation will run from 19 August until 30 September 2019.
