Kent County Council has received an application, and subsequently made an Order, to divert part of Public Footpath SR663 at Cowden.

Under the Highways Act 1980, an Order may be made to close or divert a Public Footpath, Bridleway or Restricted Byway where it is in the interests of the landowner and/or the public to do so. In considering a proposal, the County Council will have regard to whether the new route is substantially less convenient to the public and the impact of the proposed diversion on the public enjoyment of the route as a whole.

UPDATE: This Order was confirmed on 11 November 2020 and will take effect after 28 days.

The Order comes into force on 9 December 2020 but if a person aggrieved by the Order wants to question its validity or that of any provision contained in it on the ground that it is not within the powers of the Highway Act 1980 as amended or on the ground that any requirement of the Act as amended or of any regulation made under the Act has not been complied with in relation to the Order he or she may under paragraph 2 of Schedule 2 to the Act as applied by Paragraph 5 of Schedule 6 to the Act, within six weeks from 20 November 2020 make an application to the High Court.
