(WIDTH RESTRICTION) ORDER 2017

Road Traffic Regulation Act 1984

The Kent County Council in exercise of its powers under Sections 1(1), 2(1), (2), (3), 4(2) and Part IV of Schedule 9 of the Road Traffic Regulation Act 1984 (the Act of 1984), as amended, and of all other enabling powers and after consultation with the Chief  Officer of Police in accordance with Part III of Schedule 9 to the Act of 1984, hereby make the following Order:-

The general effect of this Order is to prevent any vehicle with a maximum permissible width which exceeds 6’-6’’ (2 metres) to proceed in those lengths of road specified in the Schedule of the Order. Exemptions are provided in the Order for; access to land & properties, permit holders, vehicles engaged agricultural activities, emergency services, authorities in pursuance of statutory powers and vehicles engaged in such building operations as maintenance, improvement or demolition. Full details of the exemptions are provided in the articles of the Order.

Roads subject to a 6’- 6’’ (2 metres) Width Restriction stated below

BETHERSDEN ROAD, (HOTHFIELD); from its junction with Pluckley Road (Hothfield) south-westwards to its junction with Bethersden Road (Bethersden)

BETHERSDEN ROAD, (BETHERSDEN); from its junction with Bethersden Road (Hothfield) south-westwards via Fridd Corner to its crossroad junctions with Old Surrenden Manor Road and Pluckley Road

A statement of the Council’s reasons for making the Order, a map indicating the location and the effect and a copy of any other Orders which will be amended by the Order may be examined on Mondays to Friday at The Kent County Council, Sessions House, Maidstone, ME14 1XQ, and at The Kent County Council, Kent Highway & Transportation, Ashford Highway Depot, Henwood Industrial Estate, Unit 4 Javelin Way, Ashford, Kent TN24 8AD during normal office hours or downloaded from the consultation document section below.

Anyone may, by application to the High Court within 6 weeks of the date of publication of this Notice, challenge the validity of the Orders or of any provision contained in them on the grounds that it is not within the powers conferred by the Road Traffic Regulation Act 1984, or any instrument made thereunder, or that there has been a failure to comply with any statutory requirement in relation to the Orders.
