Kent County Council has received an application, and subsequently made an Order, to close divert part of Public Footpath MR355 at West Peckham.

Under the Highways Act 1980, an Order may be made to close or divert a Public Footpath, Bridleway or Restricted Byway where it is in the interests of the landowner and/or the public to do so. In considering a proposal, the County Council will have regard to whether the new route is substantially less convenient to the public and the impact of the proposed diversion on the public enjoyment of the route as a whole.

UPDATE: This Order was confirmed on 4th May 2021 and will take effect on the 1st June 2021.

The Order comes into force on the 1st day of June 2021, but if a person aggrieved by the Order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act which has not been complied with in relation to the Order, he or she may under Paragraph 2 of Schedule 2 to the Act as applied by Paragraph 5 of Schedule 6 to the Act, within 6 weeks from the 27th day of May 2021 , make an application to the High Court.
